  2. Lodge a trademark – you need to make sure your new trademark will fall under the correct category, before you submit your application. The more relevant the category is to your product, the more protection you are likely to have.
  3. Be prepared for the examination process – the Australian Trademarks office will have a close look at your application, and look for any difficulties or conflicts. If they find problems, you will receive a written report that highlights the issues. If all goes according to plan, the examination process should take around seven months, if there are problems, it could take a lot longer.
  4. Registering your trademark – once you have reached this stage, you are now able to register your trademark, but you’re not out of the woods just yet. Your application to register your trademark will be made public and published in the Trade Marks Journal. Publishing of your application occurs so potential difficulties or objections can be made before you finally register the trademark for your product.
